Joint car finance: who is liable for what when two people sign

What a joint car finance application actually means
- Liability is joint and several, not shared. Each borrower can be pursued for the entire balance, not for a half share. If one stops paying, the other owes the whole amount, and the arrears appear on both credit files. That is the same structure as a guarantor agreement with both parties in the front seat.
- Both files are searched and both are linked. A joint application creates a financial association between the two people at the credit reference agencies. It survives the agreement and affects both parties' future applications until it is formally broken, which is a step most people forget to take.
- Financing a car for somebody else is refused for a reason. An agreement where the named borrower is not the main driver misrepresents the risk the lender is pricing, and it is usually a term of the agreement that the borrower is the keeper and principal driver. Lenders decline it; where it is done anyway, it is a breach rather than a loophole.
- The usual alternative is a guarantor. Where one person has the income and the other needs the car, a guarantor agreement puts the driver on the agreement and the supporter behind it. It is the honest version of what a joint application is often being asked to do.
Common questions
- Can you get joint car finance from most motor lenders?
- Fewer than offer joint mortgages. It exists, most often between spouses or partners at the same address, but it is not standard across the motor market and many lenders will point you at a guarantor product instead.
- Can I add someone to an existing agreement?
- Not usually. The agreement was underwritten on the person who signed it, so adding a second name is a new application and a new agreement, with a settlement of the old one in between.
- Can I finance a car for someone else to drive, such as my son or daughter?
- You can take an agreement in your own name for a car you own and insure, and you remain the borrower and the keeper. What you cannot do is put your name on an agreement for a car that is really theirs, which the terms normally prohibit.
- What happens to a joint agreement if we separate?
- Both remain liable until it is settled. The usual routes are one party settling and refinancing alone, or the car being sold and the agreement cleared from the proceeds.
